maPlatine.com photo contest: my vinyl records and me!

Dates:

The contest begins on Monday 24 September 2012 at 00h01 a.m. and ends on 21 October at 11:45 p.m.. Winners will be announced on 30 November.

Terms and conditions:

The purpose of the contest is to post a photo of yourself with the cover of your favourite vinyl record.

To enter, go to maplatine.com's Facebook page. Go to the 'My records and me contest' tab. If you're not already a fan, click on 'Like' and activate the 'Enter' button. All you need to do now is post your photo as instructed.

Entrants can post up to three photos.

All the photos will be available in the contest photo gallery. You can then vote for your favourite photos. The photo with the most likes will win the contest. 

Prize pyramid:

The winner will win a Pro-Ject Debut Carbon turntable of the colour of their choice, for a value of €319, courtesy of Pro-Ject.

There will be a draw between the next 5 photos with the most likes for the following prizes:

-       Two Rock On Wall frames worth €44, courtesy of Rock On Wall

-       A set of 3 vinyl records worth €45, courtesy of Beast Records

-       A set of 2 vinyl records worth €30, courtesy of Beast Records

TERMS AND CONDITIONS OF THE FACEBOOK® CONTEST 

"My records and me"

Article 1 – Definition and conditions for entering the contest

MAPLATINE.COM, having a capital of €22,000 is registered in the French company register in RENNES under the number 533 519 575 RCS RENNES, having its head office at QUAI DUGAY TROUIN, RUE DE ROHAN 35000 Rennes, is organising a contest without any purchase obligation as part of an online marketing campaign.

• MAPLATINE.COM is also hereinafter referred to as: 'The Organiser'

• The contest 'Entrant' is also hereinafter referred to as 'the Entrant'

• The 'Winner' of the contest is also hereinafter referred to as 'the Winner'.

The contest will be hosted on the website's Facebook® page available at the following address throughout the contest: https://www.facebook.com/maplatine?sk=wall
Entrants acknowledge that they are familiar with the Facebook®'s confidentiality policy, available directly on the Facebook® website. Facebook®'s offices are based at: 1601 S. California Ave., Palo Alto, CA 94304.

Article 2 - Entry terms and conditions 

The contest is open to any physical individual, aged 18 and over, residing in mainland France, with Internet access and a Facebook® account (http://www.facebook.com), following the acceptance of the entry terms and conditions, pursuant to the French data protection law.

One entry per physical person and up to 3 photos posted per physical person are accepted throughout the contest.

This contest is not open to members of MAPLATINE.COM personnel, professional photographers, as well as their family members. They are however authorised to 'vote',in accordance with article 4.3 

Article 3 – Dates of the contest

- contest start date: Monday 24 September 2012 at 00:01 a.m.

- contest end date: Sunday 21 October 2012 at 11:45 p.m.

- photos and votes are can be submitted until: Sunday 21 October 2012 at 11:45 p.m.

Article 4 – Terms and conditions of entry

4.1 – Terms and conditions for posting photos

Four steps are required for entry to be approved by the Organiser.  Contestants must:

a) log in to the website's Facebook® page available at the following address throughout the contest: https://www.facebook.com/maplatine?sk=wall 

b) click the 'LIKE' button on the Facebook® Page 

c) click on 'become a fan to enter the contest'

d) click on 'send a picture' then 'select a picture' and check the user rights in article 4.2. 

d) you MUST add a photo with a 'title" and click on 'Save'.  

According to the technical possibilities made available by Facebook®, this information (title) may be changed or added to subsequent to the posting of the Photo from the 'Edit photo' option available from the Photo displayed in the 'Fan Photos' on the MAPLATINE.COM page

The Photo will appear (according to Internet speed) and open to votes by following the procedure below:

a) click on 'become a fan to enter the contest' 

b) position the mouse cursor on the photo you want to vote for and click on 'vote'. 

c) you may vote for as many photos as you want

Note that at the end of this post, Facebook®'s 'Comment' and 'Tag this photo' features are accepted by not mandatory (see 4.4).

4.2) Warranties and responsibility for the validity of the pictures/artwork

By entering this contest, entrants accept that they grant all intellectual property right to MAPLATINE.COM and authorise MAPLATINE.COM to use these photos in other media for promotional, marketing or other purposes. MAPLATINE.COM also retains the right to edit, modify or make any changes it sees fit for internal or external use. 

MAPLATINE.COM retains the right to cancel, terminate or amend this contest if it does not roll out as planned: any virus, bug, violation, unauthorised intervention, fraud, action from a competitor, technical problem or any other cause beyond MAPLATINE.COM's control that may alter and affect the administration, security, equity, integrity, or running of MAPLATINE.COM.

When uploading a photo, entrants agree to defend, declare or uphold the harmlessness of MAPLATINE.COM and its agents against any complaint, legal proceeding or responsibility for any prejudice, loss or damage resulting from participation in the contest (including use of the photo) or the approval or use of the award won. 

Entrants warrant that their artwork is original, unique (reproducing existing artwork is prohibited), that they are the sole owners of the rights to use associated with the artwork and that they have the consent of physically identifiable individuals portrayed in the artwork. 

To this end, Entrants must seek the authorisation of all third parties involved either directly or indirectly in the creation of the artwork (or who consider that they can claim any right whatsoever) and must bear any charges incurred. 

As a general rule, Entrants warrant the Organisers of this contest against any actions, legal proceedings or complaints that could be taken or filed by a third party for whatever reason, during the exercise of the rights transferred, and more generally, for the purposes of applicable warranties and commitments. 

Entrants certify that they are the authors of the images posted and adhere to the principle of copyright. 

Photos portraying minors under 18 are not authorised and fall under the author's responsibility, for child protection purposes, with the sole exception of members posting photos of their own children.

Incomplete or erroneous entries will be rejected, without the Organiser being held responsible. Any entrant making an unfaithful statement will be banned from the contest without the Organiser being held responsible.  

As such, Organising Company MAPLATINE.COM retains the unreserved right to moderate subsequently and not to validate, and even exclude, remove from the contest, any entrant, any photo that breaches one of the conditions of the terms and conditions, the author of which is suspected of fraud or violating the integrity of the contest. 

Should MAPLATINE.com identify any moral offence via the publication of photos of a pornographic or offensive nature, MAPLATINE.COM also retains the right to delete the photo.

4.3 – Vote and ranking terms

- To vote, sign in to the website's Facebook® Page available at the following address throughout the contest: https://www.facebook.com/maplatine?sk=wall
a) click on 'become a fan to enter the contest' 

b) position the mouse cursor on a photo and click on 'vote'. 

c) Each Entrant can vote for their own photo as well as those of other competitors

- Entrants are authorised to invite Facebook® 'friends' on the MAPLATINE.COM Page to vote for the photo they post in keeping with article 4.

- The jury is made up of all the Facebook® users who voted at least once and according to the technical possibilities provided by Facebook®. Voting for several photos is authorised.

- For the final ranking, winning photos are those that get the most 'likes' among the photos in the gallery of the contest page. 

- In case of a draw between several Photos, MAPLATINE.COM retains the right to vote for its favourite photo to decide between the winners of the same prize. 

4.4 – Note about Facebook®'s 'Comment' and 'Tag this photo' features

Facebook® makes it possible for visitors to 'comment' or 'tag friends' on each photo.

Though these contributions have no influence over the outcome of the votes, they are accepted. These contributions are under the entire responsibility of their author and the Organising Company accepts no responsibility for same and retains the right to delete them without any explanations and subject to the technical possibilities provided by Facebook®.

The contents of the contributions must not be of an illegal, libellous, pornographic, racist and hateful nature and must not undermine human dignity.

Contributions must not have a sole commercial purpose (links to a third party website, spam, etc.).

Contributions must not reproduce the contents of private correspondence without the consent of the parties involved.

Contributions must not be harmful to the parties involved in any way. 

Article 5 – Contest roll out 

The contest is rolled out as follows:

Entrants sign it at: http://www.facebook.com/profile.php?id=447452921965704&sk=app_191382930957571 and click on the 'Photo Contest' tab. 

After clicking on the 'Like' button and reading the terms and conditions:

• Entrants can play up to three times (up to 3 photos can be uploaded to enter).
• Entrants can vote for their favourite photos without as many times as they want.
• The contest will take place between 17/09/2012 and 14/10/2012.
• The photo that gets the most 'likes' wins a DEBUT Carbon de Pro-Ject turntable for a value of €429.00.
• The five following photos with the most 'likes' each win one of the following prizes with a drawing of lots: 2 Rock On Wall frames worth €44.00, a set of 3 records worth €45, a set of 2 records worth €30 courtesy of Beast Records, 2 -50% discount vouchers off 3 records worth €22.
• A drawing of lots will take place to determine 20 voters who will each win a €10 discount voucher 10€.

Article 6 – Endowments/Prizes

6.1 –Commercial value of the prizes:

Prizes are courtesy of MAPLATINE.COM and are therefore considered as 'endowments'. 

The prizes can give rise to no dispute in regards to their nature, nor to any compensation of any nature whatsoever. 

The entrant securing the largest number of votes for their photo will be appointed the winner by those in charge of the contest in the presence of a court bailiff.

MAPLATINE.COM retains the right to change the prize without prior notice. In such case, the value of the prize will be equivalent or superior to the product replaced.
No compensation in cheque or in cash for the prizes will be accepted. 

6.2 – Terms for picking up the prize and use

Pursuant to article 6, the Winner must contact MAPLATINE.COM directly and comply with the terms of use laid out in article 6.1.

Article 7 – Terms for awarding the prizes

Pursuant to article 4.3 on the electronic and countable nature of the votes, no complaint about the results will be accepted. 

One prize per physical person is accepted. The Winner list (Facebook® username of the Winning Entrant) will be posted directly on the wall of the MAPLATINE.COM Pages and the 'Fans' of the Pages will be notified of the post by Facebook® notification/messaging via the electronic contact feature only available to the Organising Company. 

The Winners will be asked to send their full contact details to MAPLATINE.COM (last name, first name, date of birth, address, city, postcode (ZIP code), country, phone number, e-mail address, as well as the winning photo in high resolution (300 dpi)) via e-mail to: jeuconcours@maplatine.com

If the entrant's details are incomplete or do not make it possible to notify them of their prize, they will be disqualified and no complaint will be accepted.

The Organiser accepts no liability for any technical failures that might occur for notifying the prize via e-mail. If the Winner fails to send the details within 8 days, they will be disqualified as Winner.

The official and personalised notifications for the allocation of prizes to the Winners with the description and terms for collecting the prizes will be sent to them by e-mail at the address they give, including a copy of the message to the e-mail address of the Organiser in question.

The Winner will then be prompted to contact the Organiser directly to arrange for the date of use of their prize under the applicable conditions (see article 6.1).

Article 8- Appointment of Winners and publication of the results

The list of Winners (Facebook® User name of the Winning Entrant) will be directly posted on the wall of the Contest Page and the 'Fans' of the page will be directly notified by Facebook® notification/messaging via the electronic contact feature only available to the Organising Company, at the latest by Friday 26 October 2012 (see Article 7 Prize draw terms and conditions).

Winning photos will be posted on the contest's Facebook® Page in the photo album, subject to the technical possibilities for which the Organiser accepts no responsibility.

Article 9 – Nominative and personal data 

By participating, entrants agree in advance to the Organisers freely using any nominative information communicated on Facebook® for their own account and on all media, for commercial or promotional purposes and irrespective of medium.

They therefore authorise the Organisers to contact them also through their Facebook® account, including via the MAPLATINE.COM Page. 

When accepting their prize, the Winners authorise in advance the Organisers to use their written or verbal statements about their prize, irrespective of form, for all audiences, for commercial or public relations purposes, press, editorial or advertorial reports of any nature and for any internal and external activity, or use these by any means whatever for their reproduction, duplication, transmission, receipt, encryption, including digitisation. 

Your personal data collected is mandatory and necessary for processing your entry in the contest. It is intended for the Organisers or subcontractors and service providers for management purposes.  

Pursuant to the applicable law, the data collected is exclusively intended for the Organisers and will be neither sold nor transferred to any third parties, in any manner whatsoever.

The Organiser accepts not responsibility for the use of personal or nominative data available to Facebook® in its capacity as host of the contest.

Pursuant to the law of 6 January 1978 on Information Technology, Data Files and Civil Liberties, amended by the law of 6 August 2004, Entrants have the right to access, correct or remove their personal information and a right to oppose, that can be exercised by writing to MAPLATINE.COM at the following address: jeuconcours@maplatine.com

The information provided by the entrant is intended for use by MAPLATINE.COM  as part of access to its service, in keeping with the general terms of sale and as part of the management of this contest. 

Article 10 – Liabilities and rights

The user bears sole responsibility for their contributions (photos, comments, votes, tags and other Facebook® features) and the Organising Company accepts no responsibility for non-conforming contributions, as laid out in article 4 or that could give rise to a complaint by a third party.

If individuals feature on photos, Entrants must make sure that the photos selected do not breach third parties' rights in any way (including the rights of subjects of photographs and right of property– right of portrayal of property) and that they have secured all the necessary authorisations from them for the intended use as per these terms and conditions.

In the event of dispute from a third party, irrespective of nature, only the responsibility of the Entrants will be invoked.

The Organiser is entitled to modify the terms of notification before the prizes are drawn, if necessary or relevant. In such case, the entrant will be entitled to remover their photograph(s). Entrants have no further rights.

The Organisers:

• Retain the right to amend, extend, reduce, limit the prizes or cancel the contest in the case of force majeure as set forth by case law. As a consequence, they accept no responsibility for such circumstances.

• Inform that, considering the characteristics of the Internet network, such as the free harvesting of the data circulated and the difficulty, and even impossibility, to control the use that could be made of it by third parties, they accept no responsibility for any inappropriate or fraudulent use of such data.

• Accept no responsibility for any fraudulent use of the access rights or allocation of a prize of an Entrant.

• Accept no responsibility in the event of failure of the Internet network, telephone lines, receipt hardware that could affect the execution of the contest. Furthermore, they accept no responsibility for any problems regarding the transport or loss of any e-mail or letter.

• Accept no responsibility for any technical failure or problem, hardware or software, irrespective of its nature (virus, bug, etc.) occurring on the Entrant's system, their IT system and on the data stored and any consequences that could affect their personal, professional or business activity.

• Accept no responsibility for any poaching and damage to the artwork.

• Accept no responsibility for any problems with the contest prizes and any direct and indirect damage they may cause. 

• Accept no responsibility for access to the contest, hosted on Facebook® servers.

• May at any time, including for technical and update reasons, temporarily close access to the Page and the Contest. The Organisers accept no responsibility for such interruptions and the consequences thereof. No compensation may be claimed on the above grounds.

The contest is not run or sponsored by Facebook®. Facebook® therefore accepts no responsibility for any dispute related to contests. For any questions, comments or complaints regarding the contest, contact the organisers, not Facebook®. Any content posted is subject to moderation. The organising company has the right, in a fully discretionary manner, to accept, refuse or delete any content, including content already uploaded, without having to provide any justification.

Article 11 – Exclusion conditions

Entry in these contests involves unreserved acceptance of the terms set out in these terms and conditions by the Entrant and without any precondition, failure to comply with these terms and conditions lead to exclusion from the contest, the voiding of their entry and the allocation of prizes.

Article 12 – Registration

They can be sent upon request and are available on the Facebook® Page of the contest or on the website http://www.maplatine.com/content/50-jeu-concours

Postage costs will be reimbursed on the basis of the applicable longer delivery rates in France.

Only one reimbursement and shipment will be sent per household (same name, same address). Upon request in writing sent to the same addresses as in article 8, the costs for access to Internet, for reading the terms and conditions and entering the drawing of lots will be reimbursed at the applicable local tariff at peak time (connection costs reimbursed on the basis of 5 minutes of connection to the PSTN).

An application for reimbursement must come with justification from the telecom operator or internet service provider, indicating the date, time and call time. It is understood that no reimbursement will occur if the entry is made as part of an unlimited deal (Broadband, Cable or other).

Reimbursement of sums (stamp or connection) will be done by bank transfer or via cheque, to be determined by the Organising Company, subject to the complainant providing all the information required for the operation.

Article 13 – Competent courts

These terms and conditions are governed by French law.

The parties must endeavour to find an amicable settlement of any dispute arising from the interpretation and execution of these terms and conditions. Should the dispute persist, it will be settled by the competent courts.

The Entrant acknowledges that they have read these terms and conditions, that they accept them unreservedly and adhere to them fully.
